>From my experiences, I found some old OSs (ex. win98) send MSS -12 octects size 
packets, when they do fast retransmit. I'm not sure, but this might be related 
to your case.

The 12 bytes size may be related to the time stamp option somehow, 
but I've checked that the time stamp was not used in the connections.
